COLLECTIVE WOMEN PUBLIC DEFENDERS OF BRAZIL publicly endorses the REPUBLIC NOTE, formulated by the National Network of Popular Lawyers and Advocates - RENAP-PE, AGAINST THE DECLARATIONS OF MANOEL JERÔNIMO, THE GENERAL PUBLIC DEFENDER OF THE PERNAMBUCO CONCENTRATE, ON 11 JANUARY 2018.

And to reaffirm the commitment to gender and race equality, the confrontation of stereotypes, prejudice, discrimination, any institutional violence, especially that embedded in the expression of the Public Defender's Office.

On 11 in January 2018, Defender General Public Manoel Jerônimo, in an interview with Radio Recife, commenting on the cases of harassment and rape against women, stated that “a busy place, a woman in a miniskirt, The woman is subject to a person interpreting that she is seducing or perhaps giving opportunity for flirting, dating and maybe even something more serious. So it is important that she symbolically demonstrate that she is not there for any kind of flirting and the garments show that a lot. […] The symbolism of dress says a lot for the purpose of prosecution, for the purpose of conviction or acquittal in the criminal field. ”

With these words, the Chief Public Defender of the State considers that, in case of sexual crime, the clothing that the woman wore at the time of the aggression should be taken into consideration by the judge for the purpose of reducing the sentence and even for the acquittal of the perpetrator, in a clear movement of blaming the victim herself for the violence suffered.

The Defender's statements, though shocking, are not isolated in Brazil. In a country that in the year of 2017 had about 135 daily rapes, of which 10 of them are cases of collective rapes (data from the Brazilian Public Security Forum and the Ministry of Health), several jurists still defend the judiciary as an instrument of control. sexual / patrimonial behavior of women's bodies and lives. They forget, however, that far more important than regulating the clothing of raped girls, adolescents, youth, adults, and older women is to educate men to respect the sexual freedom and dignity of all women and to understand that clothes are not TALK

Contrary to what the Public Defender claims by stating that the robes serve as a “symbolism” of women's will - nullifying women's autonomy and ability to speak - it is crucial to teach boys and men that there is no other way to know about the woman's will beyond the positive, conscious and sober statement about her desires and wishes. No, it is no, and the absence of yes is no.

Blaming the victim is just one of several tools for maintaining the patriarchy system, which exercises territorial control over women's bodies, all with the purpose of early eliminating women's autonomy, keeping them away from public spaces and therefore, the political, economic and social decision-making spaces that govern their own lives.

Therefore, it is necessary to denounce the violence contained in the speeches produced in the penal field, including those speeches allegedly aimed at the defense of guarantees. The process of constructing the legal discourse by indoctrinators and actors operating in practice the criminal justice system (male subjects) is not neutral. The criminal liberalism reinforced by the Pernambuco General Public Defender is founded on clearly patriarchal and oppressive biases and reveals how deeply embedded in public institutions the culture of rape is still.

Despite the chauvinistic, misogynistic and violent forces that roam the world of law and the lives of all women, we will continue to swim hand in hand toward a world where women can wear whatever clothes they want, walk around whenever they want. street, with or without a companion, without fear of being assaulted, raped and raped by men who will be released from accusation because of the ideas defended by the Public Defender and so many other people in society.

It is never the fault of the victim.

Together we are stronger.
